This document is the second district-wide local plan to be adopted by Kennet District Council. It contains the local planning authority's policies and proposals for the development and use of land and will guide development and investment within the District up to the year 2011. The adopted Kennet Local Plan has full statutory status and supersedes all previous local plans in the District. Together with the Wiltshire Structure Plan (External link) and the Wiltshire and Swindon Minerals Local Plan (External link) forms the Development Plan for Kennet.
The local plan was prepared in accordance with the Planning and Compensation Act 1991 and all current Government advice, including Planning Policy Guidance Notes (PPGs) (External link) and Planning Policy Statements (External link). The Plan is also in general conformity with the adopted Wiltshire Structure Plan (External link) and Regional Planning Guidance for the South West (RPG 10) (External link). The main stages leading to the adoption of the Local Plan are illustrated in Table 1.1.
A statutory local plan carries considerable weight. Section 54A of the Town and Country Planning Act 1990 states:-
"..where, in making any determination under the planning Acts, regard is to be had to the development plan, the determination shall be made in accordance with the plan unless material considerations indicate otherwise."
A greater level of detail in applying and implementing local plan policies is provided by supplementary planning guidance. These documents have been formally adopted by the Council after public consultation. They cover subjects such as planning obligations, planning briefs and village design statements.
Essentially this means that an applicant who proposes a development which is clearly in conflict with the development plan will need to demonstrate why the plan should not prevail.
The Local Plan was formally adopted by the Council on 30th April 2004. Copies may be purchased from the Council Offices in either printed format or on CD ROM.

‘Saved’ Policies (pdf, 1170 KB)
The adopted Kennet Local Plan is a “saved plan” until September 2007, under the provisions of the legislation. As the Core Strategy is not anticipated to be adopted until 2010, the Secretary of State has agreed to save key policies of the local plan for a further period of time up to the Core Strategy’s adoption. Inspector’s Report
The Inspector’s Report on the Public Local Inquiry into the Replacement Local Plan was received on April 9th 2003. The Inspector Mr R L Muers, was appointed by the Secretary of State to hold a public inquiry into objections to the Replacement Kennet District Local Plan. The inquiry was held at The Corn Exchange, Devizes, between 12 March 2002 and 20 August 2002, and sat on 38 days.

Changes to the Plan Suggested by the Council during the Course of the Inquiry (pdf, 619 KB)
During the course of the Public Local Inquiry, the Council informally agreed a number of changes to the Plan, referred to by the Inspector as “Suggested Changes”.

This study has been undertaken by the Forward Planning and Transportation team of Kennet District Council to inform the forthcoming Public Local Inquiry into the emerging Replacement Kennet Local Plan.
